1. General

1.1 These are the terms of use of HC Rotterdam with regard to the Website and App. Please read these terms of use ("Terms of Use") carefully before using the Website and/or App ("User") and/or registering as a member of HC Rotterdam via this Website and/or App ("Member") and/or register as a volunteer ('Volunteer'). This Website is the property of HC Rotterdam.

1.2 By visiting and/or using this Website and/or App and/or registering as a Member and/or Volunteer, you indicate that you have taken note of and agree to these Terms of Use.

1.3 If you do not agree with one or more of these Terms of Use, HC Rotterdam requests that you do not use this Website and/or App and/or do not register as a Member and/or Volunteer.

2. Definitions

2.1 In these terms of use the following terms have the following meanings:

App: the web application of HC Rotterdam, which is managed by LISA Ledeninformatiesystemen BV

Content: including, but not limited to, text, computer software, scripts, graphics, photos, sound, music, videos, audiovisual combinations, interactive elements and other materials that the User makes available via the Website and/or App.

User: any user of the Website and/or App, including Members and Volunteers.

Terms of Use: these general terms of use of HC Rotterdam.

HC Rotterdam: association Sports Association HC Rotterdam, located at Hazelaarweg 2, 3053 PM in Rotterdam and registered with the Chamber of Commerce under number 40342444.

Member: natural person or the parents or legal representatives of a child up to and including 17, who participates in HC Rotterdam activities.

Volunteer: the person who registers as a volunteer via the Website and/or App.

Website: the HC Rotterdam website, www.hcrotterdam.com, and other social networks on which HC Rotterdam has a profile, including Facebook (hcrotterdam), YouTube, Instagram and Twitter.

3. HC Rotterdam services

3.1 The services provided by HC Rotterdam via the Website and/or App consist of providing information about the association and its activities in the field of hockey.

3.2 In addition, Members and Volunteers are able to create a personal and/or team profile via their own accounts, change their personal details and upload Content.

3.3 HC Rotterdam is responsible for the information it provides via the Website and/or App or otherwise. HC Rotterdam strives to provide current and reliable information. Nevertheless, HC Rotterdam cannot guarantee that all published information is actually current, correct and complete in all cases and at all times. No rights can therefore be derived from the data and information presented on the Website and/or App.

3.4 If you have any doubts about the accuracy, completeness and/or topicality of the data on the Website and/or App or if you discover (possible) inaccuracies, we recommend that you contact HC Rotterdam via [email protected]

3.5 HC Rotterdam strives for a well-functioning system for the Website and/or App and the facilities that will be continuously available, with the exception of maintenance work.

3.6 HC Rotterdam expressly does not guarantee that the Website and/or App can always be used (in a proper manner) or that the Website and/or App is continuously accessible, as the Website and/or App by its nature is not (completely) ) is interference-free. HC Rotterdam will do everything reasonably required to resolve malfunctions in the Website and/or App as quickly as possible, insofar as these malfunctions are not attributable to third parties.

3.7 HC Rotterdam is entitled at any time to immediately block access to (parts of) the Website and/or App and/or limit the use of the Website and/or App for Users in connection with maintenance and security.

4. User Obligations

4.1 Users guarantee at all times that they are authorized to use the Website and/or App and that they will act and behave in all respects as may be expected of responsible and careful (internet) users and members. This includes adhering to and acting in accordance with these Terms of Use.

4.2 Users are fully responsible and liable for their own use of the Website and/or App and the accuracy of the (personal) data they provide. Users also guarantee that they are fully authorized to provide and make Content available.

4.3 Users do not post unauthorized commercial Content on the Website and/or App.

4.4 Users shall not post offensive, hateful, threatening, harassing or defamatory Content. Users will not use the Website and/or App for any unlawful, misleading, malicious or discriminatory activity.

4.5 By (voluntarily) making Content available via the Website and/or App, a User hereby transfers the intellectual property rights to this Content to HC Rotterdam, whether or not in advance. HC Rotterdam does not transfer these intellectual property rights to third parties. If and to the extent that any right is not transferable, the User hereby grants HC Rotterdam an irrevocable, exclusive license. Intellectual property rights include all copyrights and other intellectual property rights in the Netherlands or elsewhere, which are related, among other things, to the HC Rotterdam Website and/or App.

4.6 If a User is a minor, the legal representative or parent of the User hereby gives permission, whether or not in advance, for the transfer of the intellectual property rights, insofar as they rest on the Content, or for the granting of a irrevocable, exclusive license as referred to in REF _Ref381276452 \r \h 4.5.

4.7 Users acknowledge and guarantee that they are fully entitled to the Content made available by them via the Website and/or App and that they are entitled to grant the above-mentioned license to HC Rotterdam.

4.8 Users acknowledge and guarantee that the Content available to them via the Website and/or App does not infringe intellectual property rights or any other rights of third parties, is in any way contrary to the law, public order and/ or morals and/or are otherwise unlawful towards HC Rotterdam and/or third parties.

4.9 Users agree that they will only use the Website and/or App for purposes that are permitted under the Terms of Use, an agreement with HC Rotterdam and/or applicable laws or regulations.

4.10 In the event that HC Rotterdam becomes aware of a possible violation of these Terms of Use and/or applicable laws or regulations, HC Rotterdam reserves the right to remove Content posted by Users and/or at any time, without prior notice and in our sole discretion, terminate a User's access to the Website and/or App and/or terminate a Member's membership.

4.11 In cases where a User does not comply with the permitted use of the Website and/or App, including use contrary to what is further described in these Terms of Use, HC Rotterdam reserves the right to claim all damage caused as a result. to recover the relevant User.

5. Privacy

5.1 HC Rotterdam uses and processes your personal data in accordance with its privacy statement, which can be found on the homepage of the Website at www.hcrotterdam.com and/or via the App.

6. Intellectual property rights

6.1 The Website and/or App and all facilities made available by HC Rotterdam via the Website and/or App, including but not limited to data, audio and visual material, databases, images, links, texts, files, HTML codes, software and logos, contain data, files, programs and/or other materials of which the intellectual property rights belong to HC Rotterdam and/or third parties.

6.2 Without prior written permission from HC Rotterdam or the relevant rights holder, it is expressly not permitted to make available the facilities, sound and visual material, images, the Website and/or App and its content (in whole or in part) public. or to use it in any other way that causes damage to or takes unfair advantage of the reputation of the intellectual property rights or any other rights of HC Rotterdam or the relevant rights holder.

6.3 In the event of any infringement of the intellectual property rights of HC Rotterdam and/or third parties, HC Rotterdam reserves the right to fully blame all damage suffered by HC Rotterdam and/or third parties on the user of the Website and/or App. including Users, Members and Volunteers.

7. Liability

7.1 HC Rotterdam is not liable for any (direct or indirect) damage arising from or related to the use (or the impossibility of use) of the Website and/or App and/or its content, nor for any (direct or indirect) damage arising from or related to the use (or the impossibility of use) and/or the content of the Website and/or App that is in any way (in particular by means of (hyper)(text)link( s) or metatag(s)) are connected to the Website and/or App. HC Rotterdam is also not liable for (the content of the) services and/or information of possible third parties, which may be offered in any way via the Website and/or App.

7.2 HC Rotterdam is expressly not liable for any actions and/or omissions of its Users, including the Content made available by them via the Website and/or App. HC Rotterdam also gives no guarantees with regard to the content of this Content.

7.3 HC Rotterdam is furthermore not liable for damage resulting from the use of electronic means of communication via the Website and/or App, including - but not limited to - damage resulting from non-delivery or delay in delivery of electronic messages, interception or manipulation of electronic messages by third parties or by software/equipment used for electronic communications and transmission of viruses.

7.4 The Website and/or App contains links to other websites and/or servers that are not managed by HC Rotterdam or for which HC Rotterdam is not otherwise (jointly) responsible. HC Rotterdam is in no way responsible for the content of such other websites. HC Rotterdam provides such links solely as a convenience to its Users and their inclusion does not constitute a recommendation of the content of such websites. Please be aware that other websites and/or servers to which you connect from the Website and/or App may have terms or conditions that differ from those set forth in these Terms of Use.

7.5 The above limitations of liability do not apply if the damage is the result of any intent or gross negligence on the part of HC Rotterdam.

8. Indemnification

8.1 Each User indemnifies HC Rotterdam or any third parties against all damage resulting from claims by third parties regarding the violation or non-compliance with these Terms of Use, or against any claims and/or damage from third parties that are otherwise related to and/ or arise from any use of the Website and/or App by the User in question. The indemnification also relates to all damage and (legal) costs that HC Rotterdam suffers or incurs in connection with such a claim.

9. Other provisions

9.1 These Terms of Use contain all agreements made between the parties regarding the use of the Website and/or App. If one or more of the provisions in these Terms of Use are (partially) invalid, the other provisions will remain in full force. In such a case, HC Rotterdam will replace the invalid part of the Terms of Use with provisions that are valid and whose legal consequences, given the content and scope of these Terms of Use, correspond as much as possible to those of the invalid part.

9.2 HC Rotterdam reserves the right to unilaterally adjust or change the Terms of Use. The most current Terms of Use can be found at any time via the HC Rotterdam Website and/or App. In such a case, HC Rotterdam will inform the Users as best as possible. If Users continue to use the Website and/or App after changes to the Terms of Use, they are deemed to have irrevocably accepted these changes to the Terms of Use. HC Rotterdam therefore advises Users of the Website and/or App to regularly consult the Terms of Use via the Website and/or App.

9.3 Failure by a party to exercise any right or to exercise any legal remedy does not constitute a waiver of that right or legal remedy.

9.4 Any verbal promises and agreements have no effect unless they have been confirmed in writing by a party.

9.5 These Terms of Use are governed by Dutch law. Disputes arising between HC Rotterdam and third parties as a result of the Terms of Use will be submitted exclusively to the Rotterdam court, location Rotterdam.
